The Truth About AI Detection Tools and Disabled Students

Artificial intelligence (AI) is changing the world of education — but not always for the better. While schools rush to adopt AI detection tools to catch academic misconduct, many don't realize these tools carry serious risks for disabled students.

At Covenant of Courage, we believe it's time to talk honestly about the biases, inaccuracies, and dangers of AI detection — especially when it comes to students with disabilities.

Here’s the truth you need to know.

What Are AI Detection Tools?

AI detection tools like Turnitin’s AI Checker, GPTZero, and others are software programs designed to predict whether a piece of writing was generated by an AI (like ChatGPT).

Schools are increasingly using these programs to flag work they believe may be “unauthorized” — but there’s a huge problem:

These tools are NOT reliable.

Even companies that create AI detectors admit they can produce false positives — meaning they wrongly flag human-written work as AI-generated.

Why Disabled Students Are at Higher Risk

Disabled students are particularly vulnerable to being misidentified by AI detection tools for several reasons:

1. Simplified Writing Styles

Many students with disabilities — such as learning disabilities, ADHD, autism, or cognitive processing disorders — are trained to write clearly, simply, and directly. Ironically, this type of writing is exactly what many AI detection tools mistakenly flag as "too structured" or "too basic" — characteristics they associate with AI.

2. Use of Assistive Technology

Students with disabilities often rely on speech-to-text programs, grammar tools, or word prediction software to complete their assignments. These supports can make writing look "mechanically polished," causing AI detectors to wrongly assume the student didn’t write it independently.

3. Misunderstood Writing Patterns

Neurodivergent students may have unique writing patterns — such as repetitive phrasing, formulaic structures, or unusual vocabulary choices — that confuse AI detectors not trained to recognize diversity in human writing.

The Legal and Ethical Problem

When schools rely on AI detection alone to accuse students of misconduct, they risk violating federal disability laws — including:

  • Section 504 of the Rehabilitation Act (protecting against discrimination)

  • The Americans with Disabilities Act (ADA) (ensuring equal access)

  • The Individuals with Disabilities Education Act (IDEA) (guaranteeing fair educational opportunities)

Accusing a disabled student based on unreliable AI detection can amount to discrimination, denial of access, and retaliation.

Disabled students have the right to fair evaluation, accommodations, and due process — not suspicion based on faulty technology.

What Schools Should Be Doing

Schools have a legal and moral responsibility to ensure fairness for disabled students, including:

✅ Reviewing accusations carefully and considering disability accommodations✅ Asking for human-reviewed evidence — not relying solely on AI flags✅ Providing students a chance to explain and defend their work✅ Allowing accommodations that involve technology supports without penalty✅ Training staff to recognize the limitations and biases of AI detection tools

What Students and Families Can Do

If your child is accused of AI misuse based on a detection tool, remember:

  • Request all evidence in writing. Ask specifically if AI detection tools were used and demand a copy of the report.

  • Explain disability-related supports. Clarify how your child’s accommodations or learning style may have influenced the writing.

  • Involve your Disability Resource Center (DRC) or advocate.

  • Challenge false accusations. Schools must evaluate the student's case individually, not just rely on machine output.

You have the right to defend your child’s work, protect their dignity, and demand a fair process.

Final Thought: Technology Should Serve Students — Not Hurt Them

AI detection tools are not infallible. Hey were not built to understand the wide diversity of human learning, thinking, and expression — especially for disabled students.
